Terms of Use
Please carefully review these Terms of Use ("Terms"), which govern your access to and use of GlowUp's services, including our mobile applications ("Apps"), websites ("Sites"), and all associated features (collectively, the "Services"). By accessing, using, or subscribing to the Services, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not accept all provisions of these Terms, you are prohibited from using the Services.
We reserve the right to modify these Terms at our sole discretion. Any changes will be posted on the Services and will become effective immediately. Continued use of the Services after such changes constitutes your acceptance of the revised Terms.
The Services are exclusively available to individuals who are at least 18 years of age. By using the Services, you represent and warrant that:
You are 18 years or older and legally capable of entering into and fulfilling the obligations outlined in these Terms.
You have not been convicted of an indictable offense, any criminal offense involving sexual misconduct, or any other offense that would render your use of the Services unlawful.
You have not previously been suspended, deactivated, or blocked from the Services, and you are not using the Services for competitive purposes against GlowUp.
You agree to use the Services only in compliance with all applicable laws, regulations, and these Terms.
To create a GlowUp Account, you must provide a valid email address, phone number, and password. We may verify your account via SMS or a specified posture photo. You are permitted to create only one (1) unique account. Your profile and any publicly visible content must not include contact information (e.g., telephone numbers, addresses, URLs, or email addresses) or third-party media. All information you choose to make public may be viewed by other users.
You are fully responsible for maintaining the confidentiality of your account login credentials. Notify us immediately at support@glowupup.com (subject: "GlowUp Account Security Breach") if you suspect unauthorized access or a security breach. Exercise caution when accessing your account from public devices to prevent unauthorized viewing of your information. GlowUp is not liable for any losses resulting from account theft, misappropriation, or third-party security incidents.
The Services are for your personal, non-commercial use only. You may not authorize others to use your account, transfer your usage rights, or use the Services for commercial activities. GlowUp reserves the right to disable, suspend, or terminate any account at our sole discretion, without prior notice, for any reason (including but not limited to policy violations, fraudulent activity, or harm to other users).
Using the Services on mobile devices may incur data charges from your cellular provider. You are solely responsible for all data, roaming, and connectivity fees associated with your usage.
You assume all risks associated with online and offline interactions through the Services, including dating and social engagements. GlowUp does not screen user backgrounds, verify user-provided information, or guarantee the conduct of other users. We encourage you to review our Safety Tips and exercise caution, especially when meeting users in person. Treat all users with respect and comply with the User Conduct rules outlined in Section 3(g).
You are strictly prohibited from engaging in the following activities:
Using the Services unlawfully, harassingly, or in a manner that infringes on others’ rights.
Engaging in lewd, threatening, predatory, or stalking behavior.
Using the Services in safety-critical contexts (e.g., while driving) where failure could cause harm.
Disrupting service functionality, overburdening systems, or interfering with other users’ access.
Impersonating others, misrepresenting your identity, or falsifying affiliations.
Promoting commercial ventures, political platforms, or religious/cult activities.
Defrauding users, collecting personal data without consent, or sending unsolicited messages (spam).
Using automated tools (bots, scrapers), malware, or phishing techniques.
Redistributing user content without permission or redirecting users to third-party sites.
Use the in-app "Report" feature to flag violations of these Terms. While we make reasonable efforts to review reports, we have no obligation to remove flagged content or accounts and do not guarantee specific actions.
GlowUp may investigate and take action against users who violate these Terms, including account termination, legal proceedings, or content removal, at our sole discretion and without prior notice.
"User Content" includes all material you post, transmit, or display through the Services (e.g., text, photos, videos, profile information). You retain ownership of your content but are solely responsible for its accuracy, legality, and compliance with these Terms. GlowUp does not control or endorse User Content and is not liable for any harm arising from it.
By submitting User Content, you grant GlowUp a perpetual, worldwide, non-exclusive license to use, modify, reproduce, distribute, and publicly display your content for service operation and promotion. We may review, edit, or delete content that violates our policies, without notice or liability.
The Services, including software, logos, designs, and user interfaces ("Proprietary Materials"), are the exclusive property of GlowUp and its licensors. You are granted a limited, non-transferable license to access the Services for personal use only. Any unauthorized use, including copying, reverse-engineering, or commercial exploitation, is strictly prohibited.
The Services may contain links to third-party sites or content for your convenience. We do not endorse or control these third parties and are not responsible for their content, privacy practices, or services. Your use of third-party resources is at your own risk.
GlowUp offers paid services, including virtual currency ("GlowUp Coins") and premium subscriptions ("Subscriptions"). Payments are processed through third-party platforms (e.g., Apple iTunes, Google Play). All fees are non-refundable, and pricing is subject to change with notice.
Subscriptions auto-renew unless canceled through your third-party account before the term ends. Cancellations are effective for the next billing period, and you will retain access until your current term expires.
The Services are provided "as is" and "as available," without any warranties of accuracy, security, or availability. We do not guarantee that the Services will be error-free, virus-free, or uninterrupted, and we disclaim all liabilities for user interactions, content accuracy, or third-party actions.
In no event will GlowUp or its affiliates be liable for direct, indirect, consequential, or punitive damages arising from your use of the Services. Our total liability is limited to the amount you have paid for the Services in the 12 months preceding the claim.
You agree to indemnify and hold GlowUp harmless from any losses, damages, or legal fees resulting from your violation of these Terms, including infringement of third-party rights or misuse of the Services.
We may terminate your account immediately, without notice, for any reason (e.g., policy violations, fraudulent activity). All paid fees are non-refundable upon termination.
You may deactivate your account via "Settings" or by emailing support@3ndr.app (subject: "Account Deactivation Request"). Your profile will be hidden immediately, and your account will be permanently closed after 60 days of inactivity. User Content may remain in backups for up to 1 year for legal or operational purposes.
Sections on intellectual property, disclaimers, liability, and indemnification will survive account termination.
These Terms are governed by the laws of HongKong. Disputes will be resolved through binding arbitration in HongKong, excluding class action proceedings.
